1. Acceptance of Terms
By downloading, installing, registering for, or using the SaiyamAI mobile application (the "App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not install or use the App.
These Terms constitute a legally binding agreement between you and Shrey Jain operating as SaiyamAI ("we," "us," "our," or the "Company"), based in Katni, Madhya Pradesh, India.
2. Eligibility
- You must be at least 13 years old (or 16 in the EEA, or 18 in India) to use the App.
- If you are a minor above the minimum age in your jurisdiction but below the age of majority, you must have parental or guardian consent.
- By using the App, you represent and warrant that you meet these eligibility requirements.
3. Description of Service
SaiyamAI is a digital wellness application powered by Artificial Intelligence. The App provides:
- Plans: Set daily or hourly (Pomodoro-cycle) usage limits for specific apps. Negotiate snooze (extra time) with the AI.
- Strict Time: Block apps during specific hours. Access is intentionally difficult to obtain.
- Do Not Disturb (DND): Pause all tracking and nudges during specified hours.
- AI Chat (Plan Mode): Full-context conversations with SaiyamAI about your digital habits; access to last 7 days usage, plans, strict time, and DND settings.
- AI Chat (Nudge Mode): On-the-spot conversations when nudged on another app; access limited to that app's usage stats. No modifications to plans/settings from this mode.
- Reels Blocker: Optionally detects and redirects away from Instagram Reels or YouTube Shorts using the Accessibility Service. Can be toggled on/off at any time in Settings โ Reels Blocker.
- Reel Cap: Optionally limits how many Reels or Shorts you may scroll through per app within a time window you configure, instead of blocking the feature entirely.
- Subscriptions: Optional paid premium tiers processed through Google Play Billing. See Section 12A.
- Notifications: Weekly reports and a persistent timer bubble.
4. Account Registration and Security
- Account Creation: You must register using a valid email address, or by signing in with your Google account. You agree to provide accurate and current information.
- Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- One Account Per User: Each user should maintain only one account.
- Unauthorized Access: You must notify us immediately at support@saiyamai.com if you suspect unauthorized access to your account.
5. Required Permissions
The App requires the following Android permissions to function. You must grant these for the App to operate:

You may revoke any permission at any time in your device settings. Revoking permissions will degrade or disable the corresponding App features but will not delete your account or data.

6. App Blocking and Strict Time โ IMPORTANT DISCLAIMER
CAUTION
READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
The App is designed to block your access to other applications on your device.
6.1. Acknowledgments
By using the blocking features, you acknowledge and agree that:
- Strict Time and Plan-based blocking may prevent you from accessing any app you choose to restrict, including but not limited to phone/dialer, messaging apps, email, maps/navigation, banking, and emergency services apps.
- You are solely responsible for selecting which apps to block and during which hours.
- The AI may deny your snooze requests during Strict Time, making it intentionally difficult to regain access.
6.2. Limitation of Liability for Blocking
WE ARE NOT LIABLE for any direct, indirect, incidental, special, consequential, or punitive damages arising from your inability to access blocked applications, including but not limited to:
- Missed emergency calls, messages, or alerts
- Missed work communications or deadlines
- Financial losses from inability to access banking or trading apps
- Missed navigation or travel-related issues
- Any harm, loss, or injury of any kind
YOU USE THE BLOCKING FEATURES ENTIRELY AT YOUR OWN RISK.
6.3. Recommendation
We strongly recommend that you:
- Never block your phone's default dialer or emergency services.
- Set DND periods for work hours if needed.
- Test Strict Time with non-critical apps first.
Note on Emergency Calls: Emergency calls (112, 911, 999) are protected at the Android OS level and cannot be blocked by any third-party app. However, if you block your phone's dialer app, you may lose access to the dialing user interface. We strongly advise never adding your phone's dialer to Strict Time or Plans.
7. AI Interactions โ Disclaimer
7.1. Nature of AI
- The AI is powered by Google's Gemini models and generates responses algorithmically.
- AI responses may be inaccurate, incomplete, inconsistent, or inappropriate.
- The AI may exhibit biases and its suggestions should not be taken as professional advice.
- THE COMPANY IS NOT LIABLE for any outcome, decision, or consequence arising from your reliance on AI-generated plans, snooze decisions, usage limit suggestions, or any other AI output. You retain full responsibility for all digital wellness choices you make.
7.2. Not Professional Advice
- SaiyamAI is NOT a mental health professional, therapist, psychologist, medical doctor, or licensed counselor.
- The AI's suggestions about digital wellness are informational only and do not constitute medical, psychological, legal, or financial advice.
- If you are experiencing mental health issues related to screen time or digital addiction, please consult a qualified professional.
7.3. User Responsibilities in Chat
- You are responsible for all content you submit to the AI.
- You agree not to submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- You agree not to attempt to manipulate the AI to produce harmful, illegal, or policy-violating content.
7.4. Memories
- Memories are created only when you explicitly ask the AI to remember something.
- You can delete any memory at any time through the App.
- Memories are sent to the AI as context. See Privacy Policy Section 6 for details.
8. User Conduct and Acceptable Use
You agree NOT to:
- Use the App for any unlawful purpose.
- Reverse engineer, decompile, or disassemble the App.
- Attempt to bypass the App's blocking mechanisms through unauthorized means.
- Interfere with or disrupt the App's functionality or servers.
- Impersonate another person or entity.
- Use automated scripts or bots to interact with the AI.
- Share your account credentials with others.
9. Intellectual Property
- The App, its design, code, AI prompts, branding, logos, and all original content are the exclusive property of Shrey Jain (operating as SaiyamAI) and are protected by applicable intellectual property laws.
- Your user-generated content (chats, memories, plans) remains yours. By using the App, you grant us a limited, non-exclusive license to process this content solely for delivering the App's services as described in the Privacy Policy.
- You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
10. Data Usage and Privacy
Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key points:
- We collect only the data necessary for the App's core functionality.
- We do not currently sell your personal data to third parties.
- When we refer to "anonymised" data: your personal identity (name, email, unique account identifier) is never shared with the AI model, any third party, or any external analytics service or aggregated dataset. See Privacy Policy Section 3.4 for the full definition.
- Analytics & Crash Reporting: The App uses Firebase Analytics and Firebase Crashlytics (provided by Google) to collect app-usage events, session data, crash reports, and diagnostic information. These SDKs may read and use your device's Advertising ID (ad_id / GAID) to deduplicate analytics events. This data is used solely to improve App stability and features โ never for advertising or ad targeting. See Privacy Policy Sections 3.2, 4.5, and 7.1 for full details.
- If we decide to monetize data in the future, we will provide advance notice, update our Privacy Policy, and obtain separate, explicit consent where required by law. See Privacy Policy Section 7.4.
- You have the right to delete your account and all associated data at any time. See Privacy Policy Section 10.
11. Early Access and Waitlist
- Access to the App may be gated behind an early access program or waitlist.
- Having a waitlist position does not guarantee access or a timeline for access.
- We reserve the right to grant or revoke early access at our sole discretion.
12. Service Availability and Modifications
- We strive to maintain the App's availability but do not guarantee uninterrupted or error-free service.
- We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.
- The App offers optional paid subscriptions/premium tiers, described in Section 12A. Existing free features may be modified but we will provide reasonable notice.
12A. Subscriptions and Payments
- Billing Provider: Paid subscriptions are sold and processed through Google Play Billing. We do not directly collect or store your payment card details โ these are handled entirely by Google Play under Google Play's Terms of Service.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date, in accordance with Google Play's billing cycle.
- Cancellation: You may cancel your subscription at any time through the Google Play Store โ Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
- Refunds: Refunds are handled per Google Play's refund policy. We do not directly process refunds; please contact Google Play support or request a refund through the Play Store.
- Price Changes: We will provide reasonable advance notice of any price changes to active subscribers before the new price takes effect, as required by applicable law.
- Account Linking: To activate and verify your subscription, an obfuscated identifier derived from your account is shared with Google Play Billing at the time of purchase. See Privacy Policy Sections 3.2 and 7.1 for details.
- No Guarantee of Features: Premium features available under a subscription may be modified or updated over time; we will make reasonable efforts to notify subscribers of material reductions in premium functionality.
13. Termination
13.1. By You
You may stop using the App and delete your account at any time.
13.2. By Us
We may suspend or terminate your account if:
- You breach these Terms.
- You misuse the App or engage in prohibited conduct (Section 8).
- Required by law or legal process.
- We discontinue the Service.
13.3. Effect of Termination
Upon termination:
- Your access to the App will cease.
- Your data will be deleted in accordance with our Privacy Policy (within 30 days), unless retention is required by law.
- Sections 6, 7, 9, 14, 15, and 16 survive termination.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
The Company, its directors, employees, partners, agents, suppliers, and affiliates shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:
- (a) Your use of or inability to use the App;
- (b) The conduct or content of the AI, including inaccurate, harmful, or inappropriate responses;
- (c) Unauthorized access to or alteration of your data;
- (d) Your inability to access blocked applications, including during emergencies;
- (e) Any interruption, suspension, or termination of the Service;
- (f) Any third-party actions or content.
Our total aggregate liability to you for all claims arising from or related to these Terms or the App shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim, or $10 USD, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: your use of the App; your breach of these Terms; your violation of any third-party rights; or any content you submit through the App.
16. Dispute Resolution
16.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
16.2. Informal Resolution
Before filing any formal legal action, you agree to first contact us at support@saiyamai.com and attempt to resolve the dispute informally for at least 30 days.
16.3. Arbitration (Where Permitted)
If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of Arbitration and Conciliation Act, 1996 (India), unless arbitration is prohibited in your jurisdiction. Class action waivers apply to the extent permitted by law.
16.4. Exceptions
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
17. Changes to These Terms
- We reserve the right to modify these Terms at any time.
- Material changes will be communicated via in-app notification or email at least 15 days in advance.
- Continued use of the App after the effective date of changes constitutes acceptance.
- If you disagree with the updated Terms, you must stop using the App and delete your account.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the App, superseding any prior agreements or communications.
